These Terms regulate the use of the online store www.realmejewelry.com, which is legally operated by MOMOLETAO, SOCIEDAD LIMITADA, hereinafter referred to as "Realmejewelry." "Realmejewelry" is a registered trademark under MOMOLETAO, SOCIEDAD LIMITADA, and is used solely for representing the online marketplace, not any specific brand offered within the store. By accepting these Terms, the User acknowledges having read, understood, and accepted all provisions herein and agrees to comply with all obligations. If the User does not agree with the contents of this document, they must leave this website and will not be able to access or use the services offered.
Likewise, the User expressly and unreservedly agrees that access and use of this website, its services, and the content of those services are at their sole and exclusive responsibility.

These Terms will be accepted by both parties without reservations and may be modified at any time and without prior notice. It is the User’s responsibility to read them when making a purchase or engaging in a service. The applicable terms at the time the contract is executed will be those applied.

Applicable Regulations

This electronic contract is executed under Spanish law and specifically governed by Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE) and Law 03/2014, of March 27, for the Protection of Consumers and Users (LGDCU).

The electronic contract will not be stored by a third party, and the language for concluding it is English. These general conditions can be saved and reproduced at any time by the user making a purchase through their web browser options and must be accepted before proceeding with payment.

User Account and Error Correction

To make online purchases in this store, you may register by creating a "User Account" or make a quick purchase without registration (as a guest).

If you make a purchase as a guest, personal data will not be stored on the website, nor will it be possible to check order history. Personal data will only be kept for managing and delivering the requested products.

If you decide to register, you will receive an email confirming the successful registration and a reminder of your login details. From your account, you will be able to make purchases, check order history, change your password, modify personal data, update shipping and billing addresses, leave comments, and perform other tasks related to your purchases.

At any time, you may access your private account to verify your personal information and addresses and, if necessary, correct any errors or update the data. Shipping and billing addresses can also be corrected or updated during the purchase process.

You may unsubscribe at any time by sending an email from the address to be unsubscribed to info@realmejewelry.com, which will result in the cancellation of your personal data.

In any case, the creation and cancellation of a user account will be governed by the provisions of the Privacy Policy.

Purchase Process

Shopping at "Realmejewelry" is easy and straightforward, just follow these steps:

  1. Select the products you wish to purchase from the ones offered by “Realmejewelry.” By clicking on each product, you can access its product page, which includes a detailed description with the information, main features, and price. If you need more information, feel free to ask us. NOTE: For product pages with photographs, slight variations in color or texture compared to the website photos may occur due to factors such as monitor resolution. However, we will do our best to make the images as accurate as possible to reality.
  2. Once you have selected the product(s) you want to buy, click on the "Add to Cart" button, and the product will be added to your shopping cart. If you wish, you can continue adding more products to the cart or proceed directly to checkout.
  3. After completing your product selection, a summary will appear identifying the selected item(s). Finally, to proceed with your order, click the "Checkout" button.
  4. As mentioned in previous sections, when completing your purchase, you have the option to register or make a quick purchase without registration (as a guest). When registering, you will need to provide your contact and shipping information, and in future purchases, you won't have to re-enter your data.
  5. Lastly, you will need to accept these Terms of Sale and choose a payment method from those offered by “Realmejewelry” (see the following section).
  6. Once the purchase process is complete, we will send you an email detailing the transaction, along with a digital purchase receipt or invoice. If you do not receive this email within 24 hours or if you notice any errors in the entered data, please contact us via any of the following:

Similarly, if you have not given your consent to receive the invoice electronically, you will receive a paper copy at no extra cost. Otherwise, you can revoke your consent by contacting us using any of the previously mentioned means.

*Please note that once an order is placed, it cannot be canceled. However, you may request a return after receiving the package.

PayPal

Make your payment with your PayPal account. With this payment method, “Realmejewelry” never collects or handles any bank details. All data is processed directly by PayPal, ensuring that “Realmejewelry” offers the highest level of transparency, security, and confidentiality in the transaction.

Amazon Pay

Make your payment with your Amazon Pay account. With this payment method, “Realmejewelry” never collects or handles any bank details. All data is processed directly by Amazon Pay, ensuring that “Realmejewelry” offers the highest level of transparency, security, and confidentiality in the transaction.

Apple Pay

Shipping Terms

Shipments will be made to:

  • Mainland Spain
  • Europe
  • International

Shipments will be handled by an express courier company.

The courier typically delivers during business hours, so if you have a preferred delivery time, please indicate this in the order comments, and we will try to accommodate it (as far as the courier's route and schedule allow).

Delivery Times

The estimated delivery time will be shown during the purchase process, and it is assumed that you accept this time frame. The estimated delivery time is based mainly on reference values provided by the courier company and does not represent the actual delivery time.

If the product is not delivered within the estimated time, you must notify us of this within 7 business days after the estimated time has passed, and we will make inquiries and follow-ups with the courier company. If this notification period is not met, it is assumed that you will handle the inquiry and follow-up of the package personally. If the goods are not delivered within 90 business days after the estimated delivery time, you may notify us to file a claim with the carrier. Once the carrier's final resolution is received, we will proceed with a full refund of all payments made. Please be aware that the refund process will only begin after the claim has been fully resolved by the carrier.

If the user purchases a product that has not yet been released but already has a launch date, the delivery times will be provisional and subject to change, depending on the availability of each product from suppliers.

In some cases, there may be a lack of stock. Our staff will contact you to offer a solution and inform you of the delivery time once the selected product becomes available, or to terminate the contract if you so desire.

Important Note: In general, we are not responsible for failure to comply with or delays in obligations due to circumstances beyond our control, such as force majeure (e.g., lockdown due to a state of emergency), natural disasters, strikes, accidents, etc. We are not responsible for carrier delays.

Prices, Taxes, Fees, and Duties

Prices are expressed in Euros. “Realmejewelry” product prices may vary, but any changes will not affect orders for which a Shipping Confirmation has already been sent.

The final price of purchased products may vary depending on applicable taxes, the shipping address, and the buyer’s profile (individual or professional). For informational purposes, except for activities that are not subject to or exempt from VAT, the following taxes will apply to the items on our website:

  • The PVP of items with shipping addresses in mainland Spain and the Balearic Islands includes VAT in all cases.
  • The PVP of items with shipping addresses to other EU countries, where the buyer is an individual (non-professional), includes VAT.
  • The PVP of items with shipping addresses to other EU countries, where the buyer is a company or professional, does NOT include VAT as long as they are registered in the Intra-Community Operators Registry (in which case a valid VAT Identification Number must be provided). If they are not registered as an Intra-Community Operator, the PVP includes VAT.
  • The PVP of items with shipping addresses to the Canary Islands, Ceuta, Melilla, or any country outside the EU does NOT include VAT, as the operation is considered an export. The price indicated for each item is the final price for shipments to these destinations.

    “Realmejewelry” will not be responsible for DUA (single administrative document) fees, import taxes, and duties (ISPI, IGIC), or any customs fees or tariffs generated at the destination, if applicable.

Account Deactivation, Service Cancellation, and Blocking

User accounts are not deleted due to inactivity. Users can request account deactivation by contacting “Realmejewelry” staff, sending an email to info@realmejewelry.com, or through their account profile.

If payment for an order is not received, the order may be temporarily suspended until the user resolves the outstanding payment. If more than 15 days pass without resolution, “Realmejewelry” reserves the right to cancel the order.

“Realmejewelry” reserves the right to block access to the User account without prior notice (or directly delete the account) if the account is used in an illegal manner or violates the obligations and rules established herein. This action will be communicated via email. Blocking or deleting the User account will not affect the obligation to pay for any products already purchased, if applicable.

In exceptional cases, at the sole discretion of “Realmejewelry” administrators and based on the severity of the violation, administrators may opt to issue a warning to the infringing User before permanently deleting or blocking their account.

By registering as a User, you agree that the owners of this site reserve the right to modify or discontinue this website and its services, or to delete provided data, at any time and without prior notice, either temporarily or permanently.

Returns

At “Realmejewelry,” we want you to be satisfied with your purchase. For this reason, we offer several ways to return an item that may not meet your needs or expectations. Possible cases for returns or cancellations:

  1. The product is incorrect, defective, or was damaged during shipping:

    We take great care to ensure that all shipments are properly handled. If you still receive an incorrect item, please contact us as soon as possible to resolve the issue. Before opening the product, verify that the packaging matches the product you ordered: color, size, finish, etc.

    If the products received have any defects or damages, we will respond to non-compliance according to the "Warranties" section within these terms of sale.

    If the product was damaged during shipping, it is necessary to notify us and, if possible, note the issue on the carrier's delivery receipt.

    Products must be returned in protective packaging, such as a box or protective bag. “Realmejewelry” will arrange for a courier to pick up the merchandise at no additional cost to you. If you prefer to use a different courier than the one provided by “Realmejewelry,” and the selected courier offers higher rates, you will need to cover the difference in transportation costs.

  2. Cancellation:

    We do not want you to keep anything you don’t like, so you may return an item if it does not meet your expectations. Therefore, in accordance with the LGDCU, and provided you are purchasing an item for personal use, you have the Right of Withdrawal, allowing you to return the product as long as it is not a digital product for which the download has already started.

    The exercise of this right must be done within a maximum of FIFTEEN(15) calendar days from the date of receipt, notifying us of your decision to withdraw from the purchase. You can contact us at the following email address: info@realmejewelry.com.

    To exercise this right, the product must be in perfect condition and preferably retain the original packaging, along with all parts. If the products do not arrive in perfect condition, do not include all their parts and accessories, or do not retain the original packaging, “Realmejewelry” reserves the right to refund a lesser amount, which will be communicated to you.

    The refund for the purchase amount will be made once the condition of the merchandise has been verified, through the same payment method used for the purchase, and in any case, before FIFTEEN(15) calendar days have passed from the date of receipt of the withdrawal request, provided that “Realmejewelry” manages the collection of the item. If you return the item through a courier service of your choice, the 14-day period will begin from when “Realmejewelry” has effective knowledge of the shipment or, alternatively, upon receipt of the merchandise.

    The costs of returning the item due to the exercise of the right of withdrawal will be borne by the buyer.

The right of withdrawal will not apply in the following cases, among others:

  • The supply of goods made to the consumer's specifications or clearly personalized.
  • The supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.

Once the order has been placed, it cannot be canceled, but you can exercise your right of withdrawal within the established period.
